Astroluxx Terms of Use

The following Terms of Use outlines your obligations when using the Astroluxx website. Please also review the Astoluxx Community Guildelines and Privacy Policy for more information.

Acceptance of Terms

The web pages available at Astroluxx.com, and all linked pages (the "Site"), are owned and operated by GNO515 Media LLC, a Texas corporation, and is accessed by you under the Terms of Use described below ("Terms of Use").

Please read these Terms of Use carefully before using the services. By accessing Astroluxx.com and its services, you agree to be bound by these terms and conditions. If you do not agree to all the terms and conditions outlined below, then you may not access the Site or its services.

Registration

As a condition for using Astroluxx and its services, you are required to register with the site and select a password and screen name. You are responsible for maintaining the confidentiality of your Astroluxx account, and are responsible for all activities that occur thereunder. Astroluxx reserves the right to refuse service to anyone at any time without prior notice or liability if you breach any of the terms and conditions in this Terms of Use.

Description of Services

Subject to full compliance with the Terms of Use, Astroluxx may offer to provide certain services and content, as described on the Site.  Astroluxx may change, suspend or discontinue services including any Content for any reason at any time. Astroluxx may also impose limits on certain features and services or restrict your access to parts or all of the Services without notice or liability.

User Conduct

As a condition of using this Site, you agree that you will use the Service in compliance with all applicable local, state, national, and international laws, rules and regulations, including any laws regarding the transmission of technical data exported from your country of residence.

By way of example, and not as a limitation, you agree not to use the Services:

• to create or submit unwanted email ("Spam") to any other Astroluxx users or any URL; or to submit stories or comments linking to affiliate programs, multi-level marketing schemes, sites/blogs repurposing existing stories (source hops), or off-topic content;

You agree that you are responsible for your own communications and for any consequences thereof.  Astroluxx reserves the right, but has no obligation, to monitor disputes between you and other users.  Astroluxx may remove any Content and Astroluxx accounts at any time for any reason; to report Terms of Use abuse, please email webmaster@astroluxx.com.

Intellectual Property and Copyright

Astroluxx respects the intellectual property of others. Astroluxx does not claim any ownership in any of the content, including any text, data, information, images, photographs, music, sound, video, or other material, that you upload, transmit or store in your Astroluxx account.

By submitting content to Astroluxx, you warrant that you own all rights to the Content, agree that the Content will be dedicated to the public domain under the Creative Commons Public Domain Dedication, available at http://creativecommons.org/licenses/publicdomain/ and that you will not object to the use of the content by Astroluxx in any context. To clarify, the above does not apply to the content on external sites linked to by the original submission.

It is Astroluxx's policy to respond expeditiously to claims of copyright and other intellectual property infringement. Astroluxx will promptly process and investigate notices of alleged infringement and will take appropriate actions, which may include removal of the infringing material.  To provide Astroluxx notice of an infringement, you must provide a written communication to webmaster@astroluxx.com that sets forth the information specified by the DMCA (http://www.copyright.gov/title17/92chap5.html#512).

Privacy

As a condition to using the Service, you agree to the terms of the Astroluxx Privacy Policy Astroluxx's current privacy policy is available at http://astroluxx.com/static/privacy-policy/.

Links to External Websites

Astroluxx serves as a gateway to content found on other websites. Astroluxx has no control over external sites and is therefore not responsible for the availability of such external sites. You acknowledge and agree that Astroluxx shall not be responsible or liable, directly or indirectly, for any content, damage or loss caused by use of these external sites.

Warranties

You represent and warrant that all of the information provided by you to Astroluxx to participate in the Services is correct and current; and you have all necessary right, power and authority to enter into this Agreement and to perform the acts required of you hereunder. You also acknowledge that Astroluxx has no control over, and no duty to take any action regarding: which users gain access to the Site or use the Services; what effects the Content may have on you; how you may interpret or use the Content; or what actions you may take as a result of having been exposed to the Content.

Indemnity

You agree to hold harmless and indemnify GNO515 Media LLC, Astroluxx, and its affiliates, officers, agents, and employees from and against any third party claim arising from or in any way related to your use of the Service, including any liability or expense arising from all claims, losses, damages (actual and consequential), suits, judgments, litigation costs and attorneys' fees, of every kind and nature. In such a case, Astroluxx will provide you with written notice of such claim, suit or action.

Termination

If you wish to terminate your Astroluxx account, you may send an email to webmaster@astroluxx.com. All provisions of the Terms of Use which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability

Due to the Children's Online Privacy Protection Act of 1998 (which is available at http://www.ftc.gov/ogc/coppa1.htm), you must be at least thirteen (13) years of age to use this Site. You must provide current, accurate identification, contact, and other information that may be required as part of the registration process and/or continued use of the Service.

Modifications of the Terms of Use

Astroluxx reserves the right, at its sole discretion, to modify or replace the Terms of Use at any time. If the alterations constitute a material change to the Terms of Use, Astroluxx will notify you by posting an announcement on the Site. What constitutes a "material change" will be determined at Astroluxx's sole discretion, in good faith and using common sense and reasonable judgment. You shall be responsible for reviewing and becoming familiar with any such modifications. Use of Astroluxx.com by you following such notification constitutes your acceptance of any updates and/or revisions to the Terms of Use.
